Terms of Service


Please note that by submitting your down payment for services you are agreeing to all of our terms of service as written here. WebsiteItUp reserves the right to change or update these terms at any time without notice.


We hate spam just as much as you do. We will never share your information with third parties unless required to do so by law or requested by you. The information we collect from you will be used to maintain your services with us and to represent the quality of our work to others, such as in our online portfolio.


Quotes provided to prospects will be honored for 30 days. A new quote will then be provided upon request. Contracts that have been written, but not signed by the client will only be accepted within 30 days of the delivery date. A new contract may be drawn up upon request.


Each website project has Four steps. 1.) The client will send WebsiteItUp the completed content (text and pictures). Once WebsiteItUp has received all the content for the website we will then proceed to loading the content, designing and building the website. 2.)  WebsiteItUp will then ask you to look over the first draft and send us any revisions, we will make the revisions you requested and have you look over the website one more time and send us any final revisions to make. 3.) If at this point the client would like to make more revisions after the initial two included in their original quote amount, the client will be charged an hourly rate of $65 with a minimum of 1 hour. After all revisions are made the final payment will be requested. 4.) Upon receiving payment we will then make the final revisions as well as teach you how to add future content and update your webpage on your own.


All text and photos used as content in a commissioned website must be provided by the client (unless the client has hired WebsiteItUp for content development). The client must have ownership or written permission to use all content he/she provides for use. It is up to each client to ensure his/her design and/or content does not infringe on any trademark, service mark, or copyright. (Professional writing and stock photo services are available for a surcharge if the client needs assistance with content development). WebsiteItUp cannot be responsible for intellectual property infringements on behalf of clients. Also, WebsiteItUp cannot be responsible for submitted content. Clients should not mail irreplaceable photos or documents or send content that must be returned.


All content must be submitted electronically via email (contact us for the correct email address) Exceptions to this policy must be approved in advance and will incur a surcharge.

WebsiteItUp works hard to complete all projects in a timely manner. We will provide you with an estimated time of delivery for your project. However, we do not guarantee deadlines as each project is unique and so is each customer. We will communicate with you during the entire development of your project and provide you with status updates.

Please understand that additional services, revisions to design or development of your site and delays in providing us with the information we require will significantly add to the delivery time

If you require your website to be done in an expedited time we will be happy to accommodate your needs but there will be an expediting fee. This fee will vary on a case by case basis.

If we are unable to communicate with a client on a project for a duration of 90 calendar days by phone or email during the design and development process, the project will be canceled without prior notice and no refund of the deposit will be issued.


Once a site has been completed and live, there are no refunds. In the event of a cancellation of contract, ownership of all artwork, layouts and development remain copyrighted to WebsiteItUp and will not be transferred to the client.
WEBSITE DESIGN/DEVELOPMENT – Refunds of the fees paid for development of the website may be issued on accounts cancelled within 90 days of the initial sale and prior to the completion of the website according to the following schedule:

A) A minimum of a 50% cancellation fee will be retained by WebsiteItUp on cancelled accounts even if no work has been started and no content yet submitted by the Client.
B) A minimum of a 75% cancellation fee will be retained by WebsiteItUp on cancelled accounts if work has been presented to the Client; or WebsiteItUp has made multiple attempts to work with the Client, and Client has not responded to those attempts.
C) A 100% cancellation fee will be retained by WebsiteItUp and NO REFUND issued if any changes and/or modifications requested by the Client have been completed by WebsiteItUp. No Refund will be issued on any website cancelled after services have been rendered, including but not limited to, the design work having been completed and/or the website taken live.
D) 100% cancellation fee will be retained and NO REFUND will be issued by WebsiteItUp if Client cancels after 90 days from the initial sale.


Upon completion of a custom website design and payment of web design and development fees, the client is the owner of the commissioned website. The client may continue to use the commissioned website to promote the client’s company or organization regardless of whether he/she chooses to continue further services with WebsiteItUp. The client does not have the right to resell the design or development to other companies. The client does have the right to add pages onto the existing site or have another company add pages onto the existing site using the commissioned website design/development.


One-half of the initial website design and development fees are due upon project initiation. Final Payment is due within 15 business days of completion. If payment is not made the website will be taken offline. After which, if the project resumes, there will be a $50 fee added to the final payment for putting the webpage back online.

Payment for monthly services such as Maintenance or Marketing are due within net 15. WebsiteItUp charges a late fee of 10% of the total outstanding balance for invoices not paid by the end of the calendar month (net 25). Accounts at net 60 are at risk of termination, including the suspension of a website or the removal of a website from the server, resulting in a loss of website traffic and a drop in search engine ranking. Clients experiencing financial hardship should contact WebsiteItUp to discuss payment options.


If a billing error is noticed, the client should immediately contact WebsiteItUp. Refunds of overpayments will be made for up to a maximum of three months, so clients are urged to check billing statements regularly. Additionally, WebsiteItUp reserves the right to bill clients for accidental undercharges for a maximum of up to three months. Refunds of more than three months will not be processed.


If the client changes his/her mind about doing work with WebsiteItUp during the course of the initial web design or development phase, the client will be responsible for the amount of work already completed. Depending in the amount of work completed at the time of cancellation, this may mean receiving a full refund, a partial refund, no refund, or owing additional fees.

In order to protect clients from unintentional service interruption, clients wishing to terminate any services must request the service termination in writing.


SEO services have a minimum contract of three months of service OR an initial set up fee of $300. After the three month period, services are on a month to month basis. Cancellation of SEO services requires 30 days written notice.


WebsiteItUp reserves the right to decline to do business with any client for any reason.


WebsiteItUp reserves the right to change these terms of service at any time for any reason.
